THE CITY COUNCIL OF SALT LAKE CITY, UTAH, MET IN REGULAR SESSION ON THURSDAY, AUGUST 9, 1984, AT 6:00 P.M. IN ROOM 301 CITY AND COUNTY BUILDING.

 

ON ROLL CALL THE FOLLOWING COUNCIL MEMBERS WERE PRESENT: RONALD J. WHITEHEAD ALICE SHEARER GRANT MABEY IONE M. DAVIS SYDNEY R. FONNESBECK EDWARD W. PARKER EARL F. HARDWICK.

 

Council Chairperson Ronald Whitehead presided at and Councilmember Ione Davis conducted the meeting.

 

Mayor Ted Wilson was absent from the meeting.

 

PETITIONS

 

Petition No. 400-53 of 1983 submitted by M. Carl Larsen.

 

RE: Rezoning of property on the southwest corner of 8th South and West Temple from “R-6” and “B-3” classification to a “C-3A” classification.

 

Leigh von der Esch, city council executive director, briefed the Council on the request and indicated that there was a letter submitted from planning and zoning which indicated the number of housing units and persons living in the area.  Councilmember Hardwick said that he was opposed to the rezoning because of the lack of depth of the property and did not feel a building could be built there. He felt the block has been “slummed out” purposely in order to rezone. 

 

Councilmember Fonnesbeck felt the homes were at one time nice, however, restoration costs would be prohibitive. She said the biggest problem with the homes is their location. She was concerned with the fact that “C-1” takes on the height of the adjoining zone, which is “R-6” and has a height allowance for 75 feet. There are no 75 foot buildings in that “R-6” zone and she felt that the rezoning could have a negative impact on the homes. She said that the “R-6” should be changed to “R-5A” so that the height will not be 75 feet. Consideration should be given to the houses in the “R-6” zone.

 

Councilmember Mabey asked how many homes in the “R-6” are owner-occupied homes. He was informed that approximately 50% are owner-occupied. He said that the commercial may not necessarily be the right solution, however, nothing has been done for several years in this neighborhood. This may make the homeowner realize that there is some value and work to keep up their homes.  Councilmember Whitehead said that the block in question will affect the blocks west and if something is not done, the other blocks will become run down. He said that if this is not rezoned, the area will not improve, but deteriorate.  Councilmember Shearer indicated that “C-1” requires a 10 foot rear yard. Councilmember Fonnesbeck was concerned about the narrow alley and the proposed 72-75 foot building located directly on the 10 foot line.  Larry Livingston, city council legislative analyst, explained in response to Councilmember Fonnesbeck’s suggestion to rezone the “R-6” to “R-5A”, that basically there is no difference in the two zones at the present time because variances can be obtained for “R-5”. The Planning Commission is presently considering a recommendation which would limit building heights to 45 feet in “R-5” zones. He felt “R-5” would create problems for the commercial area along West Temple because of the low height.

 

Councilmember Whitehead was concerned about what type of building the developer has planned and if the Council limits the height, they may not build and then the block will deteriorate even more.  Ms. von der Esch, said that conditions subsequent could be drafted into the ordinance. Councilmember Fonnesbeck felt that conditions would not be legally binding.

 

Councilmember Parker moved and Councilmember Mabey seconded to rezone the southwest corner of 8th South and West Temple from “R-6” and “8-3” classifications to a “C-1” classification and request that Councilmember Mabey meet with the petitioner to discuss conditions for the rezoning prior to adoption of an ordinance, which motion carried, all members voting aye, except Councilmember Fonnesbeck and Councilmember Hardwick who voted nay and Councilmember Shearer who was absent when the vote was taken.

Petition No. 400-200 of 1984 submitted by 7-1l Stores (Southland Corp.).

 

RE: An ordinance amending Section 51-12-7 of the Revised Ordinances by rezoning the property located on the northwest corner of 1700 South and 900 West from “R-2” to “B-3” as requested by petitioner.

 

Ms. von der Esch said that the rezoning had been approved at the public hearing and at that time the Council made three conditions subsequent pertaining to the construction and property dedication. The ordinance is to be adopted, but not published until the conditions have been satisfied. She read the conditions included in the ordinance.

 

Councilmember Mabey moved and Councilmember Whitehead seconded to adopt Ordinance 54 of 1984, rezoning a 50 foot piece of land on the northwest corner of 1700 South and 900 West with the conditions subsequent as included in the ordinance, which motion carried, all members voting aye, except Councilmember Fonnesbeck and Councilmember Shearer who were absent at the time of the vote.
