Council Meeting Rules, Parliamentary Order and Procedure

 

 

A.    WORK SESSION: Approximately 3:00 p.m. in Room 326, City & County Building, 451 South State St.

 

(Agenda items scheduled during the Council's formal meeting may be discussed during the work session. Items from the following list that Council is unable to complete in the work session from approximately 3:00 p.m. – 6:30 p.m. may be addressed in a work session setting following the consent agenda.)

 

1.     (TENTATIVE) The Council will consider a motion to enter into Closed Session, in keeping with Utah Code § 52-4-204, for any of the following purposes:

        a) A strategy session to discuss collective bargaining, pursuant to Utah Code § 52-4-205 (1)(b);

        b) A strategy session to discuss the purchase, exchange, or lease of real property (including any form of water right or water shares) when public discussion of the transaction would disclose the appraisal or estimated value of the property under consideration or prevent the City from completing the transaction on the best possible terms, pursuant to Utah Code § 52-4-205(1)(d);

        c) A strategy session to discuss pending or reasonably imminent litigation, pursuant to Utah Code § 52-4-205(1)(c);

        d) A strategy session to discuss the sale of real property (including any form of water right or water shares) if (1) public discussion of the transaction would disclose the appraisal or estimated value of the property under consideration or prevent the City from completing the transaction on the best possible terms, (2) the City previously gave notice that the property would be offered for sale, and (3) the terms of the sale are publicly disclosed before the City approves the sale;

                        e) For attorney-client matters that are privileged, pursuant to Utah Code § 78B-1-137; and

        f) A strategy session to discuss deployment of security personnel, devices or systems pursuant to Utah Code Section 52-4-205(1)(f).

 

2.     Report of the Executive Director, including a review of Council information items and announcements. ATTACHMENTS

 

3.     The Council will receive a briefing on potential motions for the proposed ordinance enacting Chapter 12.58, Salt Lake City Code, prohibiting idling of vehicles within city limits. The Ordinance will establish time limits for idling of vehicles. (Item D2) ATTACHMENTS

4.     The Council will receive a briefing regarding a resolution authorizing a Loan from Salt Lake City to KCPW Radio for its operations. KCPW Radio is applying for a loan in the amount of $250,000. (Item F1) ATTACHMENTS

 

5.     The Council will discuss proposed changes to the City Code including the City’s zoning regulations to eliminate the Board of Adjustment and the Land Use Appeals Board as land use appeal authorities and replacing the boards with an appointed professional hearing officer. The hearing officer would review and make decisions relating to variance applications, appeals of Administrative, Planning Commission and Historic Landmark Commission decisions. The intent is to provide a more streamlined and consistent appeal process for land use decisions and reduce the expenditure of City funds and staffing resources. Related provisions of Title 21A – Zoning – may also be amended as part of this petition. Petitioner – Mayor Ralph Becker, (Sustainable City Code Initiative), Petition No. PLNPCM2010-00312. 6.     The Council will discuss proposed changes to the City’s zoning regulations transferring the approval authority for Special Exceptions from the Board of Adjustment to the Planning Commission or the Historic Landmark Commission (for Special Exceptions located in a Historic Preservation Overlay Zoning District).  The zoning regulations define Special Exceptions as a use that is incidental to or in addition to the principal use (such as a home occupation or outdoor dining as part of a restaurant), or an adjustment to a specific dimension standard (such as modifications to height, yard area or fence height) that have less impact than a conditional use, but which require a careful review of building location, design, or potential impacts on the surrounding neighborhood. Related provisions of Title 21A – Zoning – may also be amended as part of this petition. Petitioner – Mayor Ralph Becker, (Sustainable City Code Initiative), Petition No. PLNPCM2010-00785. 7.     The Council will receive a briefing regarding an ordinance amending Section 12.56.170, Salt Lake City Code, relating to parking meter rates, to waive parking meter charges during the holiday season. The proposed ordinance also may clarify a scheduled 50-cent per hour increase in parking rates when the holiday season waiver ends. (The proposed ordinance is a request from the Administration to waive parking meter fees from Thanksgiving Day, November 24, 2011 to Sunday, January 1, 2012 to allow two-hour free parking downtown. The adopted budget for the City’s 2011-2012 fiscal year includes a 50-cent per hour increase in parking meter rates starting January 1, 2012.) ATTACHMENTS

 

8.     The Council will receive a briefing from Jason Mathis, Executive Director of the Downtown Alliance, and Infinite Scale Design Group, regarding recommendations for improving downtown “wayfinding” signs. (The signs provide direction for pedestrians and motorists to downtown Salt Lake City destinations and parking facilities.) ATTACHMENTS

 

9.     The Council will receive a follow-up briefing regarding a resolution adopting the Restoration, Use and Management Plan for Wasatch Hollow Open Space. The goal of the plan is to protect native vegetation, water quality, and aquatic and terrestrial wildlife habitat of Emigration Creek while providing appropriate access and educational opportunities for the public. 10.  The Council will receive a briefing regarding the City’s 10 Year Capital Facilities Plan and Impact Fees. Capital improvements involve the construction, purchase or renovation of buildings, parks, streets or other physical structures. Generally, projects have a useful life of five or more years and cost $50,000 or more. ATTACHMENTS

 

11.  (TENTATIVE) The Council will receive a briefing regarding a joint resolution with the Mayor adopting waste reduction and diversion goals for Salt Lake City and directing City staff to develop a zero waste strategic plan to achieve the City's goals. The Zero Waste Resolution formally establishes waste reduction and recycling goals. ATTACHMENTS

 

12.  (TENTATIVE) The Council will hold a follow-up discussion on the priorities identified at their September retreat, including a review of a Philosophy Statement on Arts & Culture. (The other priorities identified will be discussed at future Council Meetings and include Economic Health of the City, Neighborhoods & Schools, Local / Neighborhood Business, Parks & Open Space, Sustainability, and Transportation & Mobility.) C.    PUBLIC HEARINGS:

1.   Ordinance: Fine Tuning City Code Text Amendments initiated by Mayor Becker, PLNPCM2010-00223 

Accept public comment and consider adopting an ordinance to change the City’s zoning regulations to provide clear, consistent, and efficient land use regulations. This proposal includes the following items.  Related provisions of Title 21A – Zoning may also be amended as part of this petition. Petitioner – Mayor Ralph Becker (Petition PLNPCM2010-00223) ATTACHMENTS

 

1.     Freeway Scenic Landscape Setback – would apply freeway-landscaping regulations in all zoning districts except single/two-family districts.

 

2.     Clarify that the Zoning Administrator is the Planning Director.

 

3.     Remove the newspaper notice requirement for zoning map amendments.

 

4.     Remove all references to accessory uses on accessory lots consistent with changes made in December 2008.  This will eliminate confusion between the text and the use tables.

 

5.     Revise variance and condominium application regulations to be consistent with other land use application requirements.

 

6.     Revise sign regulations to define pennant flags and prohibit their use in all zoning districts.

2.   Ordinance: Code Maintenance

Accept public comment and consider adopting an ordinance to change the City’s zoning regulations to provide clear, consistent, and efficient land use regulations. This proposal includes the following changes for Public Notice and Appeal Requirements.  Related provisions of Title 21A – Zoning may also be amended as part of this petition. Petitioner – Mayor Ralph Becker (Petition PLNPCM2010-00784) ATTACHMENTS

 

1.     Establishes a standard notice requirement for public hearings and appeal deadline dates for all boards and commissions. Removes repetitive language for each planning process and replaces it with standard language for all public hearings.

 

2.     Requires notification of a project application to surrounding neighbors for Special Exceptions and Routine and Uncontested Matters applications. Removes the requirement for applicants to obtain signatures from the adjacent property owners.

 

3.     Requires electronic mail notification to Recognized and Registered Organizations. Removes written mail notification requirement.

1.  Resolution: KCPW Radio Loan

Consider adopting a resolution authorizing a Loan from Salt Lake City to KCPW Radio for its operations. KCPW Radio is applying for a loan in the amount of $250,000. ATTACHMENTS

G.    UNFINISHED BUSINESS:

1.  Resolution: Interlocal Cooperation Agreement with Salt Lake County for Cost Sharing on the 2011 - 2016 Utah Pollution Discharge Elimination System (UPDES) Media Campaign

Consider approving an agreement with the County to share costs for a storm water pollution awareness campaign. (The City will partner with the County and other cities in funding education to increase public awareness regarding the prevention of pollution in the storm water system, and help reduce the impacts of runoff on streams and on the Jordan River.) 2.     Resolution: Izhevsk, Russia promotion from Friendship City to Sister City status 

Consider adopting a joint resolution of the City Council and the Mayor of Salt Lake City approving the establishment of a Sister-City relationship between Izhevsk, Russia and Salt Lake City, Utah. ATTACHMENTS

3. Resolution: Local Building Authority of Salt Lake City, Creation and Organization 

Consider adopting a resolution approving the organization of the Local Building Authority of Salt Lake City, Utah, and certain documents relating thereto; authorizing all necessary actions in connection therewith; dissolving the Municipal Building Authority of Salt Lake City, Salt Lake County, Utah and providing for related matters.

(The Authority would be a mechanism to issue lease revenue bonds for public projects, for example the Glendale Library. A Local Building Authority is the successor to a Municipal Building Authority.) ATTACHMENTS

4.     Ordinance: Repeal of Chapter 5.56

Consider adopting an ordinance repealing Chapter 5.56 (Rooming Houses and Boarding Houses), Salt Lake City Code, As part of the Landlord Tenant/Initiative (also known as the Good Landlord Program), Chapter 5.14 (Rental Dwellings), Salt Lake City Code, was recently amended to include rooming houses and boarding houses in the definition of a "rental dwelling". Chapter 5.56 is no longer needed because rooming houses and boarding houses are regulated by Chapter 5.14.

Consider adopting an ordinance (the “2011 Assessment Ordinance”) approving an assessment list and levying an annual assessment upon property in Salt Lake City, Utah Lighting District No. 2 (the “District L02”); establishing the effective date of the 2011 Assessment Ordinance; providing for a procedure to contest an assessment; and related matters.
