II. Procedure

 

Employees classified in the 300, 600 and 700 pay schedules may appeal a discharge, suspension without pay for more than two days (2 shifts for employees who work shifts longer than 8 hours) or involuntary transfer from one position to another with less remuneration. The following procedural steps shall apply:

       

A.     Appeal to Department Head. Within ten (10) business days of an action described above or the employee’s knowledge of the action, the employee may request in writing a review and response by the director of the employee’s department.

 

B      Employee Appeals Board. If a non-civil service employee classified in the 300, 600 and 700 pay schedules is dissatisfied with the Department Director’s response, or if the Department Director initiated the action, the employee may appeal a discharge, suspension without pay for  more than two days (2 shifts for employees who work shifts longer than 8 hours) or involuntary transfer from one position to another with less remuneration to the Employee Appeals Board by filing a written request within ten (10) business days of the Department head’s action with the City Recorder’s Office. The written request shall contain the information or be in the form set forth in Appendix A, and filed in accordance with the Employee Appeals Board Policy and Procedures.

The City Recorder forwards these written appeals to the to the City labor relations officer and to the City Attorney. The decision of the Employee Appeals Board is the final internal appeal in the City.

 

C.     Civil Service Commission. Civil service employees classified in the 300, 600 and 700 pay schedules may appeal to the Civil Service Commission a discharge, demotion and suspension without pay of more than three (3) working days or twenty-four (24) working hours.  Appeals must be filed in accordance with Civil Service Rules and Regulations. All requests for appeals must be in writing, addressed to the Civil Service Commission and filed within the time limitations contained in the Civil Service Rules and Regulations, available from the Civil Service secretary (535-7616). The Civil Service Commission follows their Rules and Regulations in the establishment and conduct of hearings. The decision of the Civil Service Commission is the final internal appeal in the City.
