SALT LAKE CITY ORDINANCE
No. 74 of 2004
(Amending the East Bench Community Master Plan
and rezoning property located at 2665 East Parley's Way)
AN ORDINANCE AMENDING THE EAST BENCH COMMUNITY MASTER PLAN AND REZONING THE PROPERTY LOCATED AT 2665 EAST PARLEY'S WAY FROM COMMERCIAL BUSINESS (CB) TO RESIDENTIAL MULTI-FAMILY (RMF-35), PURSUANT TO PETITION NO. 400-04-02.
WHEREAS, the City Council of Salt Lake City, Utah, has held public hearings before its own body and before the Planning Commission, and has taken into consideration citizen testimony, filing, and demographic details of the area, the long range general plans of the city, and any local Master Plan as part of its deliberations. Pursuant to these deliberations, the City Council has concluded that the proposed amendment of the East Bench Community Master Plan and rezoning of the property located at 2665 East Parley's Way is appropriate for the development of the community in that area.
NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. Amendment of Master Plan. The East Bench Community Master Plan, as previously adopted by the City Council, shall be and hereby is amended to change the designation for the subject property from Neighborhood Business to High Density Residential (over 20 units per gross acre).
SECTION 2. Rezoning. The property located at 2665 East Parley's Way, which is more particularly described on Exhibit A attached hereto, shall be and hereby is rezoned from Commercial Business (CB) to Residential Multi-Family (RMF-35).
SECTION 3. Amendment of Zoning Map. The Salt Lake City zoning map, as adopted by the Salt Lake City Code, relating to the fixing of boundaries and zoning districts, shall be, and hereby is amended consistent with the rezoning identified above.
SECTION 4. Condition. This ordinance is conditioned upon the filing of complete development plans consistent with the plans approved by the Planning Commission.
SECTION 5. Effective Date. This ordinance shall not become effective until the condition identified above has been met, has certified by the Salt Lake City Planning Director.
SECTION 6. Time. If the condition set forth herein has not been satisfied within one year from the execution of this ordinance, this ordinance shall become null, void and of no effect. The City Council may, for good cause shown, by resolution, extend the time period for satisfying the condition set forth above.
