SALT LAKE CITY ORDINANCE

No. 19 of 2001

 

(Amending Portions of the Salt Lake City Zoning Code

 regarding the Residential Office Zoning District)

 

      AN ORDINANCE AMENDING PORTIONS OF THE SALT LAKE CITY ZONING CODE REGARDING THE RESIDENTIAL OFFICE (RO) ZONING DISTRICT, PURSUANT TO PETITION NO. 400-00-33.

      WHEREAS, the Salt Lake City Zoning Code contains a classification known as Residential Office (RO) Zoning District; and

      WHEREAS, the City Council of Salt Lake City, Utah, finds after public hearings before its own body and before the Planning Commission, that portions of the Salt Lake City Zoning Code which relate to the Residential Office (RO) Zoning District should be amended to allow greater flexibility in the property uses allowed in that zoning district, and that such amendments are in the best interest of the City;

      NOW THEREFORE, be it ordained by the City Council of Salt Lake City, Utah:

      SECTION 1.  Section 21A.24.180.A of the Salt Lake City Code shall be and hereby is amended to read as follows:

A.    Purpose Statement. The RO residential/office district is intended to provide a suitable environment fozr existing and future mixed use areas consisting of a combination of residential dwellings and office use.  This district should encourage the maintenance and rehabilitation of appropriate existing buildings and neighborhood scale.

 

      SECTION 2.  Section 21A.24.180.C of the Salt Lake City Code shall be and hereby is amended to read as follows:

C.    Minimum Lot Area and Lot Width. The minimum lot areas and lot widths required in this district are as follows:

SECTION 3.  Section 21A.24 180 D of the Salt Lake City Code shall be and hereby is amended to read as follows:

D.  Maximum Building Height.  The maximum building height permitted in this district is four stories or sixty feet, whichever is less except:

 

   a. The height for single-family dwellings and two-family dwellings shall be two and one half stories or thirty feet, whichever is less; and

   b. If the property abuts a zoning district with a greater maximum building height, then the maximum building height in the RO District shall be six stories or ninety feet, whichever, is less.

 

      SECTION 4.  Section 21A.24.180 E of the Salt Lake City Code shall be and hereby is amended to read as follows:

      E. Minimum Yard Requirements.

         1. Multi-family dwellings and offices on greater than 20,000 square feet lot area.

            a. Front Yard.  Twenty-five feet.

            b. Corner Side Yard.  Twenty-five feet.

            c. Interior Side Yard.  Fifteen feet.

               d. Rear yard.  The rear yard shall be twenty-five percent of the lot depth, but need not exceed thirty feet.

   2. Single-family, Two family Dwellings, and Offices on lots less than                          20,000 square feet

   a. Front Yard. 20 feet.

   b. Corner Side Yard. 10 feet.

   c. Interior Side Yard.

      i. Corner Lots. 10 feet.

      ii.      Interior Lots. Four feet on one side and ten feet on the other.

   d. Rear Yard.  The rear yard shall be twenty-five percent of the lot depth, but need not exceed thirty feet.

3. Accessory Buildings and Structures in Yards.  Accessory buildings and structures may be located in a required yard subject to Part IV, Chapter 21A.36, Section 21A.36. 020B, Table 21A.36.020B, Obstructions in Yards.

 

      SECTION 5.  Section 21A.24.180 I of the Salt Lake City Code shall be and hereby is enacted to read as follows:

      I. Offices in Existing Buildings on Lots Less Than 20,000 square feet.  Offices occupying existing buildings are permitted on a 5,000 square feet minimum lot.  Additions to existing buildings that are greater than 50% of the existing building footprint or that exceed the height of the existing building shall be subject to conditional use approval.

 

SECTION 6.  Section 21A.24.190 of the Sale Lake City Code shall be and hereby is amended to add the following footnote to the list of Qualifying Provisions at the end of that section:

9.    Building additions on lots less than 20,000 square feet for office uses may not exceed 50 percent of the buildings footprint.  Building additions greater than 50 percent of the buildings footprint or new office building construction are subject to the conditional use process.

 

SECTION 7.  The table located at Section 21A.24.200 of the Salt Lake City Code entitled “Summary Table of Yard and Bulk Requirements-Residential Districts,” shall be and hereby is amended to read as set forth on Exhibit “A” attached hereto.

SECTION 8.  Effective Date.  This ordinance shall become effective on the date of its first publication.
