AN ORDINANCE VACATING A PORTION OF THE IRVING PARK ADDITION SUBDIVISION, AS REQUIRED BY § 10-9-808, UTAH CODE ANN., PURSUANT TO PETITION NO. 400-98-72.
WHEREAS, Petition No. 400-98-72 was filed with the City requesting the City to vacate a portion of the Irving Park Addition Subdivision;
WHEREAS, one hundred percent of the owners of the property within and adjacent to the subdivision have not consented to the vacation; and
WHEREAS, the City Council has reviewed the vacation which has been preliminarily approved by the Planning Commission on November 5, 1998; and
WHEREAS, good cause exists for the vacation of the portion of the subdivision and the City Council finds that neither the public nor any person will be materially injured by the proposed vacation;
NOW, THEREFORE, BE IT ORDAINED by the City Council of Salt Lake City, Utah:
SECTION 1. The City hereby approves the proposed vacation of a portion of the Irving Park Addition Subdivision, as conditionally approved by the Planning Commission on November 5, 1998. The portion of the subdivision to be vacated is more particularly described as set forth on Exhibit “A” attached hereto.
SECTION 2. Effective Date. This ordinance shall take effect upon the date of its first publication and shall be recorded with the Salt Lake County Recorder.
