PROCEEDINGS OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH
SPECIAL SESSION
SUNDAY, JUNE 12, 1988
The City Council of Salt Lake City, Utah, met in special session on Sunday, June 12, 1988, at 12:00 Noon in the City Council Conference Room, City Hall, 324 South State Street, upon appropriate order and notice scheduling such meeting according to Section 2.06.030(B) of the Salt Lake City Code.
The following Council Members were present: Florence Bittner Tom Godfrey Wayne Horrocks Roselyn Kirk Sydney Fonnesbeck Willie Stoler Alan Hardman.
Roger Cutler, city attorney, Kathryn Marshall, city recorder, and Lynda Domino, chief deputy city recorder, were present. Mayor Palmer DePaulis was absent.
Councilmember Godfrey presided at and conducted the meeting.
DEPARTMENTAL BUSINESS
FINANCE DEPARTMENT
#1. RE: A motion to override the Mayor’s veto of an ordinance amending Section 9.08.020(B) of the Salt Lake City Code reducing garbage collection fees from $4.00 to $3.00 for single-family residences; $8.00 to $6.00 for duplexes; and $12.00 to $9.00 for triplexes per month, effective January 1, 1989.

COMMENTS
Roger Cutler, city attorney, briefly explained that the fiscal procedures act allowed the Council to transfer money between departments in a budget (the administration did not have this authority) and allowed a department head to move money between line items without Council approval. In reference to the Council making an across-the-board cut, he said he thought this would violate the concept in the fiscal procedures act because the Mayor would then have the responsibility to assign money between departments, which authority he didn’t have. He said his opinion was that taking the money off the bottom line budget amount would violate policy and the separation of powers. He said that if the Council was going to make an across-the-board cut then his first preference would be that they specify each line item and his second preference would be that they specify the amount from each department. The Council discussed the budget as Committee of the Whole.
