THE CITY COUNCIL OF SALT LAKE CITY, UTAH, MET IN REGULAR SESSION ON THURSDAY, APRIL 10, 1986, AT 5:00 P.M. IN ROOM 211 CITY AND COUNTY BUILDING.
THE FOLLOWING COUNCIL MEMBERS WERE PRESENT: FLORENCE BITTNER THOMAS M. GODFREY SYDNEY R. FONNESBECK ROSELYN N. KIRK EARL F. HARDWICK WILLIE STOLER.
Councilmember Mabey was absent. Mayor Palmer DePaulis and Roger Cutler, city attorney, were present. Kathryn Marshall, city recorder, and Lynda Domino, chief deputy recorder, were absent.
Council Chairperson Hardwick presided at the meeting.
DEPARTMENTAL BUSINESS
FINANCE DEPARTMENT
#1. RE: A franchise agreement with U.S. Telecom.
ACTION: Councilmember Kirk moved and Councilmember Godfrey seconded to adopt Ordinance 32 of 1986 granting to U.S. Telecom Inc., a Kansas Corporation authorized to and doing business in the state of Utah, Its successors and assigns, the right and privilege to construct, erect, operate, and maintain over and under city streets, alleys and public ways, wires, cables, and underground conduits, in connection with its telecommunication business, which motion carried, all members present voting aye except Councilmember Bittner who voted nay.
DISCUSSION: Councilmember Bittner indicated that her concern at the Tuesday Council meeting, April 8, was that the Council had not reviewed the documents at that time. She objected to the administration requesting action on items without giving the Council a right to review the information. She also objected to giving the grantee the right to trim trees. Joe Williams, U.S. Telecom, said that the cable would be below ground. He said there would be no new lines above ground and they would use existing Mountain Bell lines. He also said that they needed to install the wires underground to protect the fiber optic cables. Councilmember Bittner said if the company was not requesting above-ground rights then there was no need to refer to above-ground rights in the ordinance.
