A.  WORK SESSION: 5:30 p.m., Room 326, City & County Building, 451 South State Street 

(Items from the following list that Council is unable to complete in Work Session from 5:30-6:55 p.m. will be addressed in a Work Session setting following the Consent Agenda.)

1.     The Council will interview Christopher Otto prior to consideration of his appointment to the Open Space Lands Advisory Board.

2.     The Council will interview Guillermo J. Arce prior to consideration of his appointment to the Capital Improvement Program Board.

3.     The Council will interview Christine A. Johnson (Chris), Orin A. Howell, Patrick W. Leary, Francisca Blanc and Adrian Comollo prior to consideration of their appointment to the Human Rights Commission. (New Board).

4.     The Council will receive a briefing regarding Sidewalk Replacement Special Improvement District 2004/2005 Fiscal Year, Job No. 102119 involving the installation of concrete sidewalk and at the property owners’ option, driveway approaches, curb and gutter. The district is bounded by 1500 East to 1900 East and Sunnyside Avenue to 1300 South. (Unfinished Business Item F1)

5.     The Council will receive a briefing regarding an ordinance to rezone property located at approximately 1532 and 1560 West 200 South from Single Family Residential to Neighborhood Commercial.  (Petition No. 400-03-10 Shaw Homes, Inc.)

6.     The Council will receive a briefing regarding a revision to the Zoning Ordinance definition of “automobile” so that sales of motor scooters and motorized bicycles will be allowed in zoning districts that otherwise prohibit the sales of automobiles. (Petition No. 400-05-12)

7.     The Council will receive a briefing regarding an ordinance relating to the Employee Appeals Board and employee discharge or transfer.

 

 

8.     (Tentative) The Council will consider a motion to enter into Executive Session for the purpose of strategy sessions to discuss the purchase, exchange, or lease of real property when public discussion of the transaction would disclose the appraisal or estimated value of the property under consideration or prevent the public body from completing the transaction on the best possible terms, pursuant to Utah Code Ann. § § 54-4-4 and 54-4-5(1)(a)(iv), and attorney-client matters that are privileged, pursuant to Utah Code Ann. § 78-24-8.

9.     Report of the Executive Director, including a review of Council information items and announcements.

 

B.   OPENING CEREMONY:
Council Member Dale Lambert will preside over the Formal Council Meetings during the month of October.

1.    Ordinance – Permitted and Conditional Uses for Commercial Districts (Department Store Locations)

Accept public comment and consider adopting an ordinance amending Table 21A.26.080, of The Salt Lake City Code, pertaining to permitted and conditional uses for Commercial Districts, pursuant to Petition No. 400-04-29.

F.  UNFINISHED BUSINESS:

1.  Resolution – Notice of Intention, Sidewalk replacement Special Improvements District, 2004/2005 Fiscal Year, Job No. 102119 and Set Protest Hearing Date (Boundaries include: 1500 East to 1900 East and Sunnyside to 1300 South)

Set the protest hearing date of  November 15, 2005 at 7:00 pm to accept protests and consider adopting a resolution declaring the intention of the City Council of Salt Lake City, Utah, to construct improvements within the city consisting of the installation of concrete sidewalks, driveway aprons, curb, gutter and asphalt tie-ins, appurtenances and all other miscellaneous work necessary to complete the improvements in a proper workman like manner; to create the Salt Lake City, Utah sidewalk replacement Special Improvement District 2004-2005 FY, Job No. 102119 (The “District”); to pay the acquisition and installation costs and expenses by special assessments to be levied against the property benefited by such improvements; to provide notice of intention to authorize such improvements and to fix a time and place for protests against such improvements, assessments or the creation of the District; to declare its official intent to reimburse itself for expenditures paid by it prior to the sale of bonds; and to authorize advertisement of construction bids and related matters.

2.  Motion – Canvass of the Salt Lake City Primary Election

Accept the official canvass of the October 4, 2005 Salt Lake City Primary Election.

                            convene with the Mayor as the

                            Board of Canvassers;

                                                            b.  Adopt motion;

                                                            c.  Adjourn as Board of Canvassers and

                                                            reconvene as City Council.

 

G. CONSENT:

1.  Property Conveyance – Lease Agreement for temporary use of a portion of the former Library Building

Consider requesting that the Administration hold a hearing at 6:00 p.m. on October 18, 2005 regarding a lease agreement for temporary use of sections of the former library building located at 209 East 500 South for an art exhibit. Compensation will be tendered.

2.  Ordinance – Set date – Amend regulations for parking lots in the Downtown (D1) Zoning District

Set date of November 1, 2005 at 7:00 p.m. to accept public comment and consider adopting an ordinance amending the Salt Lake City Code regarding regulations for parking lots in the Downtown (D1) Zoning District.  (Petition No. 400-03-30)

3.   Ordinance – Set date – Close a portion of Navajo Street (1335 West) at approximately 83 South

Set date of November 15, 2005 at 7:00 p.m. to accept public comment and consider adopting an ordinance closing and abandoning a portion of Navajo Street (1335 West) at approximately 83 South.  (Petition No. 400-05-01 Richard Lether)

4.   Ordinance – Set date – Rezone parcels at approximately 1532 and 1560 West 200 South from Single-Family Residential (R-1/5000) to Commercial Neighborhood (CN)

5.   Ordinance – Set Date – Zoning ordinance text amendment to create Natural Open Space Zoning District

Set date of November 1, 2005 at 7:00 p.m. to accept public comment and consider adopting an ordinance amending Section 21A.32.105, Salt Lake City Code, creating a Natural Open Space Zoning District.  (Petition No. 400-05-20)

6.   Motion – Auditing Services – Library Block Monument

Consider adopting a motion authorizing the Council Chair to sign a letter of engagement with Hansen Barnett & Maxwell (the Council’s current Financial Auditor) to research procedures associated with transactions relating to a monument on the east side of the Library block and to determine whether existing procedures and internal controls are adequate.

7.   Board Re-appointment – Susan Webster, Police Civilian Review Board

Consider approving the re-appointment of Susan Webster, to the Police Civilian Review Board for a term extending through September 1, 2008.

8.   Ordinance – Set date – Permitted and conditional uses for Commercial Districts

Set date of November 1, 2005 at 7:00 p.m. to accept public comment and consider adopting an ordinance to amend Section 21A.30.050 Table of Permitted and Conditional Uses for the Downtown Districts to allow different types of department stores as permitted uses in various commercial and downtown zoning districts and amend the Zoning Map designation for Block 76, Plat D, Salt Lake City survey from Community Shopping (CS) to Community Business  (CB) and amending the Salt Lake City Zoning Map rezoning properties generally located at 402 East 6th Avenue and 415 East 5th Avenue.  (Petition No. 400-04-29)
