A.  WORK SESSION: 4:00 p.m., Room 326, City & County Building, 451 So. State St. (Agenda items scheduled during the Council's formal meeting may be discussed during the Work Session briefing. Items from the following list that Council is unable to complete in Work Session from approximately 4:00 p.m. – 6:30 p.m. will be addressed in a Work Session setting following the Consent Agenda.)

1.  The Council will receive a briefing regarding a proposed ordinance amending the City’s demolition regulations, Salt Lake City Code, Chapter 18.64 – Demolition and Chapter 18.97 Mitigation of Residential Housing Loss.

2.  The Council will receive a briefing regarding a proposed ordinance enacting Chapter 5.15 of the Salt Lake City Code establishing the Landlord/Tenant Initiative Program and making related changes to Salt Lake City Code, Chapter 5.04 – Business Licenses, and Chapter 5.14 – Rental Dwellings.

3.  The Council will receive a briefing on a proposed City Council Legislative Action Item to prepare an ordinance that would codify in the Salt Lake City Code an executive order requiring all transportation facilities in the public right of way owned by Salt Lake City on which bicyclists and pedestrians are permitted by law to be designed, built, operated and maintained so that users, including people with disabilities, can travel safely and independently. (Item G2)

4.  The Council will receive a follow-up briefing regarding an ordinance amending certain Sections of Title 21A Zoning of the Salt Lake City Code to provide additional clarity and consistency with existing City land use regulations regarding notice and appeals (Petition No. PLNPCM2009-00106).

5.     (TIME CERTAIN: 5:00 P.M.) The Council will receive a briefing from the Land Use Appeals Board.

6.   (TIME CERTAIN: 5:15 P.M.) The Council will receive a briefing from the Board of Adjustment.

7.  (TIME CERTAIN: 5:30 P.M.) The Council will interview Paul Murphy prior to consideration of his appointment to the Community Development & Capitol Improvement Programs Advisory Board. (Item H1)

8.  The Council will receive a briefing regarding a resolution approving (1) an Interlocal Agreement between the Redevelopment Agency of Salt Lake City, Salt Lake County, and the Salt Lake City School District Board of Education to authorize the use of tax increment to support the reconstruction of the North Temple Viaduct; and (2) an Interlocal Agreement with the Redevelopment Agency to pay Salt Lake City all tax increment funds to finance debt (North Temple Viaduct). (Item G1)

9.  The Council will receive a briefing regarding a proposed Special Assessment Area (SAA) Job No. 109014 for reconstruction of the North Temple Viaduct. (Item G4)

10.   The Council will receive a briefing regarding an ordinance amending Section 5.04.160, Salt Lake City Code, Innkeeper License Tax, by changing the description of the accommodations covered by the innkeeper license tax to more closely match the description provided in the state tax code; by providing for the innkeeper license tax to be assessed quarterly rather than annually; and by providing for the imposition of penalties and interest as provided by Sections 59-4-101 and 59-4-102 of the Utah Code.

11.  Report of the Executive Director, including a review of Council information items and announcements.

 

B.   OPENING CEREMONY:
Council Member Carlton Christensen will conduct the Formal Council Meeting.

C.  PUBLIC HEARINGS:

1.  Ordinance: Amending Northwest Community Master Plan Future Land Use Map for property located at approximately 356-358 North Redwood Road

    Accept public comment regarding an ordinance amending the land use designation of the Northwest Community Master Plan Future Land Use Map for property located at approximately 356-358 North Redwood Road from Parks/Open Space to Medium Density Residential; Juston Puchar, Crestview Holdings (Petition No. 400-08-10).

                            Staff Recommendation:   Continue hearing to November 17, 2009 at the request of the Petitioner.

 

2.   Ordinance: Residential Condominium Conversions Text Amendments

      Accept public comment and consider adopting an ordinance amending Titles 18 Building and Construction and 21A Zoning of the Salt Lake City Code pertaining to residential condominium conversions (Petition No PLNPCM2008-00409).

3.  Ordinance: Beekeeping

    Accept public comment and consider adopting an ordinance amending Section 8.04.010, Salt Lake City Code, to add definitions related to beekeeping and enacting Chapter 8.10, Salt Lake City Code, pertaining to animal control regulations to authorize beekeeping within the City subject to certain requirements.

4.  Ordinance: Chicken keeping

Accept public comment and consider adopting an ordinance amending Sections 8.08.010, 8.08.060 and 8.08.080 and enacting Section 8.08.065, Salt Lake City Code, pertaining to animal control regulations to authorize the keeping of chickens in residential districts subject to certain requirements.

5.   Resolution: Public Benefits Study, Donation Unclaimed Bicycles

      Accept public comment and consider the conclusions of a study performed under Utah Code Section 10-8-2(3), and making findings regarding value and public benefit, with respect to a donation agreement between the City and the Salt Lake City Bicycle Collective relating to unclaimed bicycles.

6.   Ordinance: Table of Permitted and Conditional Uses Text Amendments, Social Clubs as a Conditional Use

Accept public comment and consider adopting an ordinance amending the text of Section 21A.32.140 Salt Lake City Code, Table of Permitted and Conditional Uses, to list social clubs as a conditional use in a Mixed Use (MU) zoning district (Petition PLNPCM2009-00045 - Jam in the Marmalade).

7.  Protest Hearing:Sidewalk Replacement Special Assessment Area (SAA) Job No. 102154

    Accept public comment and hear public protest to: (a) finance the cost of certain infrastructure improvements consisting of sidewalks, pavement, curb and gutter, driveway approaches, and all other miscellaneous work necessary to complete the improvements in a proper and workmanlike manner; (b) defray the cost and expenses of improvements by assessments to be levied against the properties benefited by such improvements; and (c) provide notice of intention to designate an assessment area to authorize such improvements and to fix a time and place for protests against such improvements or the designation of said assessment area; and related matters.

1.  Resolution: Community Development Area (CDA) Interlocal Agreement

    Consider adopting a resolution approving (1) the terms of an Interlocal Agreement with the Redevelopment Agency of Salt Lake City, Salt Lake County, and the Salt Lake City School District Board of Education to authorize use of a portion of tax increment to support the reconstruction of the North Temple Viaduct and;

(2) Approving an Interlocal Agreement with the Redevelopment Agency of Salt Lake City pursuant to which the Redevelopment Agency of Salt Lake City agrees to pay Salt Lake City all tax increment received from Salt Lake County with respect to North Temple Viaduct CDA Project Area.

2.  Legislative Action: Council Member Luke Garrott (Complete Streets)

    Consider adopting a legislative action item requesting the Administration prepare an ordinance that would codify in the Salt Lake City Code an executive order requiring all transportation facilities in the public right of way owned by Salt Lake City on which bicyclists and pedestrians are permitted by law to be designed, built, operated and maintained so that users, including people with disabilities, can travel safely and independently.

3.  Resolution: 911 Ambulance Services License Application

    Consider adopting a resolution expressing the support of the City Council for the City to apply for the 911 emergency ambulance services license for the geographic area of Salt Lake City.

4.  Resolution: Set Protest Hearing for Special Assessment Area (SAA) Job No. 109014, North Temple Viaduct

Consider setting a protest hearing date of December 8, 2009 at 7:00 p.m. and adopting a resolution to: (a) finance the cost of certain infrastructure improvements consisting of the replacement of the existing North Temple Viaduct with an auto/light rail viaduct and related improvements together with all other miscellaneous work necessary to complete the improvements in a proper and workmanlike manner, (b) defray the cost and expenses of a portion of the cost of said improvements by assessments to be levied against properties benefited by such improvements; and (c) provide notice of intention to designate an Assessment Area, to authorize such improvements, and fix a time and place for protests against such improvements or the designation of said Assessment Area; to declare the City's official intention to reimburse itself for expenditures paid by it prior to the issuance of tax-exempt bonds; to authorize advertisement of construction bids; and related matters.

Consider approving the appointment of Paul Murphy to the Community Development & Capitol Improvement Programs Advisory Board for a term extending through June 4, 2012.

Consider approving the appointment of Barbara Riley to the Community Development & Capitol Improvement Programs Advisory Board for a term extending through June 4, 2012.

3.   Ordinance: Confirm Date: Non-Discrimination

      Confirm the date of Tuesday, November 10, 2009 at 7:00 p.m. to accept public comment and consider adopting two ordinances enacting a new Chapter 10.04 Salt Lake City Code, relating to unlawful discrimination in employment practices based on sexual orientation or gender identity and enacting Chapter 10.05 Salt Lake City Code, relating to unlawful discrimination in housing practices based on sexual orientation or gender identity.

4.   Resolution: Confirm Date: Sorenson Multi-Cultural Center

      Confirm the date of Tuesday, November 10, 2009 at 7:00 p.m. to accept public comment and consider adopting a resolution authorizing an Interlocal Agreement for Salt Lake County to operate the Sorenson Multi-Cultural Center.
