A.  WORK SESSION: 5:30 p.m., Room 326, City & County Building, 451 South State Street 

(Items from the following list that Council is unable to complete in Work Session from 5:30-6:55 p.m. will be addressed in a Work Session setting following the Consent Agenda.)

1.     Report of the Executive Director, including a review of Council information items and announcements.

2.     The Council will interview Michael Martinez, prior to consideration of his appointment to the Golf Enterprise Fund Advisory Board.

3.     The Council will interview Sydney Jayne Magid, prior to consideration of her appointment as a part-time justice court judge for the Salt Lake City Justice Court. (Item F-4)

4.     The Council will interview L. G. (Buz) Cutler, prior to consideration of his appointment as a full-time justice court judge for the Salt Lake City Justice Court. (Item F-5)

5.     The Council will receive a briefing regarding the revenue forecasts.

6.     The Council will a hold a discussion regarding the request by North Salt Lake for a voluntary boundary adjustment.  (Petition No. 400-04-11) (Item C-3)

7.     (Tentative) The Council will consider a motion to enter into Executive Session for the purpose of strategy sessions to discuss the purchase, exchange, or lease of real property when public discussion of the transaction would disclose the appraisal or estimated value of the property under consideration or prevent the public body from completing the transaction on the best possible terms, and to discuss pending or reasonably imminent litigation; pursuant to Utah Code Ann. § § 52-4-4, 52-4-5(1)(a)(iii) and 52-4-5(1)(a)(iv), and attorney-client matters that are privileged, pursuant to Utah Code Ann. § 78-24-8.

1.   Ordinance: The Solid Waste Management Facility budget, which has been prepared and submitted by the Salt Lake Valley Solid Waste Management Council for calendar year 2005, subject to specific policy directives

Accept public comment and consider adopting an ordinance regarding the Solid Waste Management Facility budget, which has been prepared and submitted by the Salt Lake Valley Solid Waste Management Council for calendar year 2005, subject to specific policy directives.

2.   Ordinance: Petition No. 400-04-04, amend the rezoning of properties at 1029 and 1031 South West Temple Street and amend the Central Community Master Plan

Accept public comment and consider adopting an ordinance rezoning the properties located at 1029 and 1031 South West Temple Street from Commercial Corridor (CC) to Residential Mixed Use (RMU), and amending the Central Community Master Plan. (Jefferson School Apartments)

3.   Resolution: Petition No. 400-04-11, request by North Salt Lake City for a voluntary boundary adjustment

Accept public comment regarding a request by North Salt Lake City for a voluntary boundary adjustment and consider adopting a resolution.  The requested action seeks to remove 80 acres from Salt Lake City’s municipal boundary and extend the municipal boundary of North Salt Lake to include the 80 acres.

1.    Ordinance: Amend annual review of taxicab maximum rates

Consider adopting an ordinance amending Section 5.72.457, Salt Lake City Code pertaining to annual review of maximum rates.

2.  Ordinances: Youth and Family Recreation and Programs Advisory Board

a.   Ordinance: Youth City Government Advisory Board

Consider adopting an ordinance repealing Chapter 2.70, of the Salt Lake City Code, relating to the Youth City Government Advisory Board.

b.  Ordinance: Youth and Family Recreation and Programs Advisory Board

Consider adopting an ordinance repealing and reenacting Chapter 2.37, Salt Lake City Code, relating to the Youth and Family Recreation and Programs Advisory Board.

3.  Motion by Council Member Eric Jergensen: Reconsideration Petition No. 400-04-02, the Avenues Community Master Plan and rezone property located at 518 East 3rd Avenue

Consider adopting a motion to reconsider a request from Mr. Jack Plumb to amend the Avenues Community Master Plan and rezone property located at 518 East 3rd Avenue from residential multi-family (RMF-35) to neighborhood commercial (CN). (Jack Plumb)

4.  Part-time Justice Court Judge Appointment: Sydney Jayne Magid

Consider adopting a resolution approving the appointment of Sydney Jayne Magid Part-time Justice Court Judge for a term extending through January 2008.

5.  Justice Court Judge Appointment:  L. G. (Buz) Cutler

Consider adopting a resolution approving the appointment of L. G. (Buz) Cutler, as a Justice Court Judge for a term extending through January 2008.

                        Staff Recommendation:   Approve with the condition that Mr. Cutler

                                                        will continue to serve as part-time judge

                                                        until a full-time vacancy occurs.

 

G. CONSENT:

1.  Property Conveyance: Lease agreement for encroachments in to the public right-of-way at 226 E 500 S

Consider requesting that the Administration hold a hearing regarding a lease agreement for the encroachment of balconies, two stairs with handrails, and landscaping improvements located on the 500 South side of the Library Square Condominiums.

2.  Property Conveyance: Lease agreement for encroachments in to the public right-of-way at 324 South State

Consider requesting that the Administration hold a hearing regarding a lease agreement with the new owner of an existing building at 324 S State. The owner is constructing a parking structure to the rear of the building, and will install a sand trap under the sidewalk to prevent grease, oils and contaminants from getting in the storm drain system.

3.  Property Conveyance: Easement allowing the extension of a secondary gas line at approximately 1050 South 650 East, Liberty Park

Consider requesting that the Administration hold a hearing regarding an easement to facilitate the extension of a secondary gas line to be installed, and allow the City to provide for future utility needs within the Park. Lease is consistent with City policy and compensation will be tendered.

4.  Property Conveyance: Lease agreement for encroachments in to the public right-of-way at 2005 South 1100 East

Consider requesting that the Administration hold a hearing regarding a lease agreement for the encroachment of an advertising sign which extends over the public sidewalk by approximately six feet. The sign existed prior to 1984 zoning changes that would forbid such signs. However, it was damaged by a storm, and the permits counter has reviewed the conditions of repair.

5.  Property Conveyance: Lease agreement for encroachments in to the public right-of-way at 404 West 400 South

Consider requesting that the Administration hold a hearing regarding a lease agreement for the encroachment of an ingress/egress ramp to comply with ADA requirements. The ramp will project into the public way on the 400 South side of the building, but will not impede pedestrian access.

6.  Ordinance: Set date – Budget Amendment #4

Set the date of January 4, 2005 at 7:00 p.m. to accept public comment and consider adopting an ordinance amending Salt Lake City Ordinance No. 63 of 2004 which approved, ratified and finalized the budget of Salt Lake City, Utah, for the fiscal year beginning July 1, 2004 and ending June 30, 2005.

7.   Ordinance: Set date - Petition No. 400-04-04, amend the rezoning of properties at 63 West Fayette Avenue

Set the date of January 4, 2004 at 7:00 p.m. to accept public comment and consider adopting an ordinance rezoning the properties located at 63 West Fayette Avenue from Commercial Corridor (CC) to Residential Mixed Use (RMU), and amending the Central Community Master Plan. (Jefferson School Apartments)

8.    Motion: Consulting Contract – Ground Transportation Study

Consider adopting a motion authorizing the Council Chair to sign a contract with Tennessee Transportation and Logistics Foundation (TTLF) for certain ground transportation consulting services.
